Terms of Service

Before you publish this: this draft is written for a launch in Adelaide, South Australia, and references Australian law specifically — but it's still not a substitute for a lawyer's review. Two things worth raising with them directly: first, Australian Consumer Law guarantees generally attach to the seller, not the marketplace, for an auction-style platform like this one — but the ACCC stated in September 2026 that the current framework is "not fit for purpose" for online marketplaces and is actively pushing for direct obligations on platforms, particularly around product safety. That's live, moving regulatory ground, not settled law. Second, a disclaimer can never override a non-excludable consumer guarantee under the ACL — the wording below is written with that in mind, but a lawyer should confirm it holds up.

1. Who these terms are between

These Terms of Service ("Terms") are an agreement between you and GADAAI (ABN 70 914 313 031) ("Gada", "we", "us"), governing your use of the Gada app and website (together, the "Service"). By creating an account or using the Service, you agree to these Terms.

2. What Gada is — and isn't

Gada is a listings and messaging platform that helps people discover, list, and discuss items for sale nearby. Gada is not a party to any transaction between users. We do not buy, sell, own, inspect, or take possession of any item listed on the Service. We do not process payments — buyers and sellers arrange payment and handover directly with each other (for example, meeting in person or via bank transfer), entirely outside the Service.

Because of this, Gada has no visibility into and no responsibility for the accuracy of a listing, the condition or legality of an item, whether a sale actually completes, or the conduct of any user you interact with. You are solely responsible for exercising judgment and reasonable caution — including when arranging to meet someone in person.

Where a seller is a private individual selling their own belongings (not acting as a business), the consumer guarantees under the Australian Consumer Law generally don't apply to that sale at all. Where a seller is acting in trade or commerce, those guarantees are owed by the seller, not by Gada. Gada is not a supplier of the items listed on the Service.

3. Eligibility and accounts

  • You must be at least 18 years old to create an account or use the Service.
  • You can sign in with Google or via an email link. You're responsible for keeping access to your account secure.
  • You must provide accurate information and keep it up to date.
  • One account per person. You're responsible for all activity under your account.

4. Listings and content you post

You keep ownership of the photos, descriptions, and messages you post. By posting them, you give Gada a licence to display, store, and process that content solely to operate the Service (for example, showing your listing to buyers, or translating a chat message on request).

You're responsible for what you list. In particular, you agree not to list or offer:

  • Illegal items, or items you don't have the legal right to sell
  • Weapons, ammunition, or explosives
  • Drugs, controlled substances, or drug paraphernalia
  • Stolen goods, or counterfeit or replica branded goods
  • Live animals, except where explicitly permitted by local law and Gada policy
  • Adult content, or anything sexually exploitative
  • Anything intended to scam, mislead, or defraud another user

We may remove a listing or message, and suspend or terminate an account, that we reasonably believe violates these Terms or the law.

5. Listing lifecycle

A listing stays active for 4 weeks from when it's posted or last relisted. After that it's marked expired and hidden from Browse. You can relist it within a further 4-week window; if it isn't relisted by then, it's permanently removed. Marking a listing as sold clears its chat history between you and that buyer.

6. AI-assisted features

Gada uses AI to help translate listings and chats, suggest a description or price range, and answer general questions through the in-app assistant. These are provided to help, not as fact or professional advice — a suggested price range is a general estimate, not a valuation, and a translation may not be perfectly accurate. You're responsible for checking anything AI-assisted before relying on it, particularly a listing's price, description, or translated meaning.

7. Location

Gada uses your device's location (or a location you enter manually) to show you nearby listings and to attach an approximate location to items you list. Buyers only ever see a listing's city or neighbourhood, never an exact address.

8. Reporting and enforcement

If you believe a listing, message, or user violates these Terms, contact us at consulting@misiara.com.au. We may investigate and take action at our discretion, including removing content or suspending an account, but we're not obligated to monitor the Service proactively and can't guarantee we'll catch every violation.

9. Disclaimers and limitation of liability

The Service is provided "as is", without warranties of any kind. To the fullest extent permitted by law, Gada disclaims all warranties, express or implied, and is not liable for: the conduct of any user; the quality, safety, legality, or accuracy of any listing; any transaction, meetup, or dispute between users; or any loss arising from your use of the Service, including reliance on an AI-generated suggestion or translation.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded, restricted, or modified. Where our liability can lawfully be limited, it is limited to, at our option, resupplying the Service or paying the cost of having it resupplied.

10. Suspending or closing your account

You can delete your account at any time from within the app. We may suspend or terminate your account if you violate these Terms, or if we reasonably believe your use of the Service creates risk or legal exposure for Gada or another user.

11. Changes to these terms

We may update these Terms from time to time. If we make material changes, we'll take reasonable steps to let you know (such as an in-app notice). Continuing to use the Service after an update means you accept the revised Terms.

12. Governing law

These Terms are governed by the laws of South Australia, Australia, without regard to conflict-of-law principles.
